Incident

Reserve Deputy Wingate and his partner were responding to an armed robbery at a convenience store when Reserve Deputy Wingate was shot and killed. Even thought the suspects had a scanner it was turned to a different frequency and they did not know the officers were on their way. The suspects wounded Reserve Deputy Wingate's partner as they fled the scene. When Reserve Deputy Wingate came aroung the building the suspects engaged him in gunfire and he was severely wounded. Reserve Deputy Wingate did manage to wound one of the suspects.

Other officers shot and killed the second suspect. Reserve Deputy Wingate died the next day from his injuries.

Arrested on a different charge the following day one of the suspects appeared to have a fresh gunshot wound. After the bullet was removed by a court order it was found to have belonged to Reserve Deputy Wingate's gun.

The suspect was set free on appeal after it was found the evidence was gathered illegally.
