When the man failed to produce one, Officer Banker cited him. As the officer walked away, the man retrieved a .22-caliber rifle from his vehicle and shot him multiple times. A nearby farmer who was a witness suffered a graze wound as he rushed to assist Officer Banker.

The suspect was convicted of murder and sentenced to life with a possibility of parole after 25 years. Parole was denied in 2012 and again in 2017.
