Patrolman McFadden and two other officials were at a house in O'Neil's Alley questioning two armed uniformed U.S. soldiers when the two suddenly attempted to 'run through' the officers with bayonets. After missing, they quickly entered the residence. As the officials demanded that the door be opened, shots were fired from inside the house. Patrolman McFadden was hit and killed instantly.
Several occupants of the house were arrested, but only one was convicted.
Private John Burdett of Company I, 12th U.S. Colored Heavy Artillery was convicted of voluntary manslaughter before a military commission on January 8, 1866. He was discharged, forfeited all pay and sentenced to five years hard labor at Albany, NY Penitentiary.
